1. Introduction and Acceptance of Terms
Welcome to Storyteller Talent Agency ("Storyteller Talent," "Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, www.storytellertalent.com, and all related services (collectively, the "Services").
By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use our Services.
2. Description of Services
Storyteller Talent Agency provides commission-based literary agency representation and related website tools, including:
a. Literary Agency Representation – Commission-based representation for select authors seeking publishing and adaptation opportunities.
b. Query, Waitlist, and Account Tools – Website forms and account tools used to manage submissions, query-interest notifications, and subscriber preferences.
3. User Eligibility and Responsibilities
By using our Services, you represent that:
- You are at least 18 years of age.
- You are the sole creator or authorized representative of the submitted work.
- All information you provide is accurate and current.
- You will not use the Services for unlawful or misleading purposes.
You are responsible for maintaining the confidentiality of your account credentials and any materials shared through our Services.
4. Terms for Website Tools
Storyteller Talent may provide query, waitlist, account, and communication tools on the agency website.
4.1 Query and Waitlist Tools
Agency website tools are used to receive query materials, collect query-reopen notifications, manage subscriber preferences, and communicate about submitted materials.
Using these tools does not create representation and does not require payment.
No Guarantee of Representation:
Participation in any website tool or waitlist does not guarantee literary representation, a publishing deal, bookstore placement, reviews, sales, or any particular commercial outcome.
Book Links and Seller Affiliate Disclosure:
Book purchase links on this website, including Amazon links and other retailer links, may include seller affiliate links associated with Kayla Bramante and/or Storyteller Talent Agency. If you purchase through one of these links, Kayla Bramante and/or Storyteller Talent Agency may receive a commission or referral fee at no additional cost to you.
Confidentiality:
Query materials and communications submitted through Storyteller Talent Agency are treated as confidential.
5. Terms for Literary Agency Representation (Commission-Based)
Scope of Services:
For represented clients, Storyteller Talent acts as an exclusive literary agent for the purpose of negotiating and selling rights to publishers, producers, and other entities.
Commission Structure:
- 15% commission on domestic advances, royalties, and earnings
- 20% commission on foreign, translation, and dramatic (film/TV) rights
No Upfront Fees:
Storyteller Talent does not charge reading, submission, or application fees.
Selectivity:
Representation is highly selective, based on professional evaluation and market readiness.
Agency Agreement:
All representation is governed by a formal written agreement specifying commission terms, scope, and termination rights.
6. Intellectual Property
You retain full ownership and copyright of your original works.
By submitting material, you grant Storyteller Talent a non-exclusive, limited license to review and evaluate your work for the purpose of providing Services.
We do not claim ownership of client works without written authorization.
7. Confidentiality and Privacy
All client communications, manuscripts, and proprietary materials are handled confidentially.
We do not sell, share, or distribute client data.
Use of personal information is governed by our Privacy Policy, available at www.storytellertalent.com/privacy-policy.
8. Disclaimer of Warranties
Our Services are provided "as is" without warranties of any kind, express or implied.
We do not guarantee:
- A publishing, film, or television deal;
- A representation offer; or
- Any particular level of commercial success.
9. Limitation of Liability
To the fullest extent permitted by law, Storyteller Talent shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits or opportunities.
Our total liability for any claim related to your use of our Services is limited to the total amount paid by you to Storyteller Talent in the preceding twelve (12) months.
10. Dispute Resolution
These Terms are governed by the laws of the State of California.
Any disputes shall be resolved through binding arbitration in Calabasas, California, under the rules of the American Arbitration Association.
Each party shall bear its own legal costs unless otherwise required by law.
11. Modifications to Terms
We may revise or update these Terms at any time.
Changes will be posted on this page with an updated effective date.
Your continued use of our Services after publication of changes constitutes acceptance of the updated Terms.
12. Clarification of Agency Model
Storyteller Talent is a literary agency owned and operated by Kayla Bramante, providing selective representation for authors. The agency operates strictly on a commission-only basis in line with industry standards (15% domestic, 20% foreign and dramatic rights). No reading or submission fees are ever charged.
Submitting a query, joining a waitlist, creating an account, or using a website tool does not create an agency relationship unless and until a written representation agreement is signed.
